A 61 year old lifeguard was forced to wear a speedo instead of his preferred thigh covering swimsuit for a swimming test.

Description

A 61 year old man who works as a lifeguard in the New York State Office of Parks, Recreation and Historic Preservation claims they want to get rid of older lifeguards at Jones Beach State Park on Long Island. He says to get them out of the lifeguard chairs, the Office has banned the thigh-covering swimsuit he likes and forced him wear a much less covering speedo.

The parks agency did not let him wear one in 2007, for the swimming test that lifeguards at Jones Beach are required to take every spring in order to remain on the staff. Until then, lifeguards who took the test could wear whatever swimwear they wanted. Forcing the lifeguard to wear a speedo can be seen as an example Exposure.


In 2011 he sued New York parks agency for age discrimination. Nor was he allowed to wear jammers the following year, when he applied to be hired anew, alongside first-time applicants who had to pass an entry exam more demanding than the retest.
