The plaintiff, James Luthe, claims that Walmart's Illinois stores unlawfully collected, stored, and used biometric data without his and other customers' consent or proper data retention and destruction policies. Walmart's stores in Illinois are equipped with cameras and video surveillance systems that allow them to collect, possess, or obtain Biometric Data. The lawsuit claims that Clearview's Biometric Database is used by Walmart to match facial scans taken in its stores with billions of facial scans. The suit also accuses Clearview of violating the terms of a settlement by selling its database of faces to US-based businesses and private entities.
